Changes in the labour legislation concerning Electronic Labor Book
The changes in the Labor Code, introduced for the first time, the Electronic Labor Book (ELB), also known as the Unified Electronic Labor Record, alongside the full electronization of the employment file. According to the legislative amendments, the National Revenue Agency (NRA) will maintain the electronic employment register containing the uniform electronic labor records of employees. The main changes will enter into force as of 01.06.2025.
The ELB contains data and circumstances related to the employee as until now as well as two additional criteria:
- agreed paid annual leave;
- days of paid annual leave used for the year of termination of the employment relationship.
Paper employment records – Until 1st June 2026 or upon termination of the employment relationship in the period between 1st June 2025 until 1st June 2026, the employers shall complete the employment book in line with the established rules and they will specify the length of employment of the employee until 1 June 2025. The employment record is then immediately returned to the employee.
Within three days of the conclusion or amendment of the employment contract and within seven days of its termination, the employer is obliged to update the data in the employment register. The NRA will provide a copy of the entry of the beginning of the employment relationship.
Changes in the Labour Code concerning Remote Work
Remote work is defined as work outside the employer’s premises, carried out using IT.
In the individual employment contract, or with an additional agreement to it, all the conditions, rights and obligations of the parties are agreed specifically in connection with remote work and its implementation.
Mixed mode of work could be established – both in the office and from the home of the employee.
Technical equipment – initially, technical equipment and maintenance of the workplace is at the expense of the employer, but the use of the employee’s own equipment can be arranged.
Compliance with the rules – The employer provides the employee with written information in advance about the responsibility and sanctions for non-compliance with the established rules and requirements of the employer.
